GENERAL CONDITIONS FOR ELECTRONIC TICKET PURCHASE


These General Terms and Conditions for the purchase of tickets electronically (hereinafter referred to as the “General Terms and Conditions”) apply to all contracts for the purchase of tickets concluded electronically via the website www.WHITE DINNER.bgwhich is operated and maintained by AVEM LTD.who sells them in his role of Organiser of the event. The Terms and Conditions apply to White Dinner® Club Members who have purchased a registration (hereinafter referred to as the Registrant or Member).

  1. MAIN CHARACTERISTICS OF THE REGISTRATIONS SUBJECT TO SALE

Art.1. (1) The subject of the purchase and sale contracts concluded through the website www.WHITE DINNER.bg are REGISTRATIONS for entertainment events (hereinafter referred to as the “Event”) and constitute a club fee entitling the Registrant to participate in the club event. White Dinner®, as well as in other events organized for registered members of the club, for each of which separate registrations are made through www.WHITE DINNER.bg.

(2) On the website www.WHITE DINNER.bg is published basic information about each individual organized Event, containing the name of the Event, the performers, the date, time and place of the Event (if the place is announced to the public, in cases where it is not a SECRET place).

(3) Where the event advertised for sale (such as the main summer event White Dinner® takes place in a secret (previously unannounced to the general public) place, it Registrant must receive from Organiser email and/or sms with the place and date, time of meeting or place of the event, as the reliability of the provided contacts is the responsibility of the individual Registrant, who provides them by completing the event registration.

  1. II. MAIN CHARACTERISTICS OF THE ORGANISER

(1) Tickets are sold through the on-line registration and sales system WEEMS through which the Organizer operates – AVEM Ltd., registered in the Commercial Register at the Registry Agency with UIC 204628877, with its registered office at Mladost 2, bl. 258A, ground floor, office 7, Mladost 2. Sofia and address for correspondence. Andrey Lyapchev 51, Euromarket BC, office 307 (hereinafter in the General Terms and Conditions referred to as the Organizer).

(2) When selling the tickets, AVEM Ltd. acts as the Event Organizer.

(3) The organiser shall determine the venue and time of the event, the price of registration/membership to the club and all other features and conditions under which the event will take place, including the conditions under which any changes to the participants such as artists and headliners, price changes, as well as changes relating to the date, time and venue of an event and the method of notifying customers of any changes.

(4) If the Organiser fails to fulfil its obligations in relation to an event, including if the Organiser cancels the event, the Organiser is legally directly liable to the persons who purchased the tickets for compensation and for the refund of the amounts paid (see section “Event cancellation. Refund of the price paid”).

III. REGISTRATION AND PAYMENT METHOD

(1) By placing an order through the website www.WHITE DINNER.bg the Registrant makes a statement for concluding a contract for the purchase of a ticket electronically within the meaning of the Electronic Commerce Act. This statement binds the customer and the order cannot be refused or changed.

2) To purchase a ticket through the website www.WHITE DINNER.bg, customers need to complete the following 6 steps through the Weems booking system

Step 1 – Select event and city, event date

Step 2 – Select the type of registration/package (Standard/Premium/Child Supplement, etc.) and number of registrations purchased.

Step 3 – Fill in details such as current email address, phone number

Steps 4 – Choosing a payment and delivery method

Step 5 – Request Review – Confirmation

Step 6 – Purchase / Payment. It happens automatically when you select:

– On-line instant payment by credit/debit card when choosing Paypal Express (with/without Paypal registration option);

– on-line with a credit/debit card through your existing Epay account;

– at a cashier via Easypay or at an ATM via Bpay, for which the Registrant must record the specified transaction number and merchant from the online platform)

– by bank transfer to the Organizer’s account.

(2) After successful submission of the request, the customer receives an email from WHITE DINNER confirming that he has registered. The registration becomes valid only after receipt of payment for the registration within 5 (five) calendar days, for which the Registrant receives an email confirmation of successful payment and a statement of conclusion of the contract for the purchase of a ticket electronically.

(3) When a ticket is ordered by the customer, WHITE DINNER reserves the selected seats for the customer. (6) In the event that the ticket price is not paid online or credited to WHITE DINNER’s bank account within 5 calendar days from the date of the order, the ticket purchase is automatically cancelled and WHITE DINNER’s obligation to hold the selected seats for the customer is cancelled.

 

  1. I DELIVERY AND COLLECTION OF TICKETS. EVENT RULES
  • Upon receipt of a valid registration via email, the Registrant will print their registration and bring it with them on the day of the event. He verifies his identity to WHITE DINNER staff who have a list of names of expected guests and check it at the venue.

 

  • REQUIREMENTS FOR STORAGE AND DISPLAY OF TICKETS. Art.9. (1) Each visitor is obliged to keep his ticket until the end of the event.

(3) Upon leaving the hall/venue, return is only against presentation of the ticket/printed registration. For the event, the Organizer may also provide other forms of attendance verification (wristbands/seals, etc.), which will be distributed on-site by coordinators upon welcoming registered guests.

(4) The Registrant is obliged to comply with the internal regulations established by the Organizer for the respective event. Violation of house rules and misuse of the ticket may be punished by a warning to leave the event.

  1. Minors attending the Events

Art.10. (1) On the basis of Art. 3, 4 and 7 of the Child Protection Act and in conjunction with the provisions of the Ordinance on Specialized Protection of Children in Public Places, minors visiting public places, including events, must be accompanied by their parents, guardians, custodians or other adult caregivers as follows:

  1. Persons under 14 years of age must be accompanied to events after 20:00;
  2. Persons 14 years of age or older but under 18 years of age must be accompanied to events after 22:00.

(2) Where the accompanying person of the minor is an adult person other than his or her parent, guardian or custodian, the latter shall be obliged to submit a declaration of consent for the child’s attendance at the event, issued in the name of the accompanying adult and containing the notarized signatures of the parents or guardians or custodians, as the case may be.

(3) Clients should note that individual Event Organisers may place specific restrictions on the age of visitors admitted. Due to the content of certain production, a regulatory act may prohibit the admission of persons under a certain age. When purchasing tickets for underage visitors, the client is obliged to check in advance with the respective Organizer whether minors and/or underage visitors are allowed at the event.

  1. CANCELLATION OF PURCHASED TICKETS

(1) Pursuant to Art. 57, par. 12 of the Consumer Protection Act, the provisions of Articles 50 to 56 on the consumer’s right to withdraw from the distance contract within the 14-day cooling-off period do not apply to the provision of services relating to leisure activities. In connection with the above legal basis, customers do not have the right to cancel tickets for entertainment events purchased electronically.

  • Cancellation of the purchased tickets before the event is possible only in the case of payment of a special cancellation fee, the express approval of the Organizer

 

  • The registrant may not tell WHITE DINNER that he/she wishes to surrender the purchased registrations and receive his/her payment back, but may give them to another user. In this case, the Registrant notifies the change by email to info@WHITE DINNER.bg indicating the name, phone number and current email address of the new user to be included in the club event.

VII. EVENT CANCELLATION. REFUND OF PRICE PAID

(1) In the event of cancellation of an event, the Event Organizer shall be responsible for the refund of the amounts paid for the tickets and for the compensation of the persons who have suffered damages due to the cancellation of the event. Cancellation of the event constitutes a failure by the Organiser to fulfil its obligation to provide the paid entertainment service.

(2) The name of the Organizer of the respective event and the seat and address of the latter shall be published on the website www.WHITE DINNER.bg in the description of the respective event.

(3) In case of refusal by the Organizer to refund the amounts paid by the Registrant in case of cancellation of the event by the Organizer, the customers may address their requests for refund directly to the Organizer at its registered office address indicated in the event description or file a complaint against the Organizer with the competent state authorities.

VIII. CONSENT TO FILMING

Art.12. By accepting these General Terms and Conditions, the customers agree to be filmed by any technical means and to use the recordings made during or in connection with the event free of charge, without limitation as to time or place.

  1. I DATA PROTECTION

Art.13. (1) WHITE DINNER is registered as a personal data controller within the meaning of the Personal Data Protection Act and, in compliance with its legal obligations, takes the necessary technical and organizational measures to protect the data against accidental or unlawful destruction or accidental loss, against unauthorized access, alteration or dissemination, as well as against other unlawful forms of processing.

(2) By accepting these General Terms and Conditions, the customers express their consent to WHITE DINNER collecting, processing and storing the personal data provided by them and using it for the purpose of fulfilling the concluded contracts for the purchase of tickets. XII. EXTREME DISPUTE RESOLUTION Art. 14. Consumers have access to out-of-court dispute resolution procedures with the assistance of alternative dispute resolution bodies. The General Conciliation Committees have jurisdiction over disputes concerning tickets purchased online.

Acceptance of these General Terms and Conditions by the customer makes them an integral part of the contract for the purchase of tickets electronically, which is concluded between AVEM Ltd. and the Registrant as a customer, through the order on the website www.WHITE DINNER.bg.
